By submitting an order to Audio Graffiti, you are acknowledging your acceptance of these terms and conditions:

All prices for digital recording include a CD or CDs that contain a
WAV (or other) file of the final recording, together with any working
files (Cakewalk or other format), any special notes, and postage and
handling. |

The price for engraving and transcription work does not include quantity
printing or binding of a manuscript into a book or manual. Price for
work of this nature will be quoted separately on request. A single printed
copy will be made available on request, or where clients do not have
an email address. Copies of final and working files will be burnt to
CD on request. |

The PDF file will be prepared as if for professional printing (600
to 1200 dpi). If you require higher resolution, you must specify this
at the time of placing your order. |

Currently, Australian residents are not required to pay GST, however,
this is subject to change without notice (GST does not apply to international
customers). |

Audio Graffiti will not be held liable for jobs that are delayed due
to factors beyond its control. |

Standard payment terms: payment of a non-refundable deposit (typically
30-50%, minimum $50AU) when you confirm your order, then the balance
payable on completion—and before release—of the first draft. |

Audio Graffiti will endeavour to produce a final version within three rounds
of drafts. That is, we will provide drafts up to three times for each job,
each time seeking your comment and feedback. Clients are responsible for
reporting all errors, inconsistencies and flaws to Audio Graffiti during this draft phase.
Audio Graffiti takes considerable effort to achieve a high standard for its clients. However,
unreasonable requests to repeatedly revise projects beyond the three drafts will incur additional fees. |

All prices are subject to change without notice (prices provided by
way of a formal quote will not be altered). |

The Client warrants that it has copyright in, or a licence to authorise
reproduction of, all music ("Works") supplied by it to Audio
Graffiti for the purposes of its orders. The Client authorises Audio
Graffiti to reproduce all and any of the Works for such purposes. |

The Client additionally licenses Audio Graffiti to use portions of
the Works in its own promotional materials to depict the quality or
range of its goods or services. |

The Client indemnifies and will keep Audio Graffiti indemnified against
any liability, loss or expense suffered by Audio Graffiti as a direct
or indirect result of any use of the Works by Audio Graffiti pursuant
to clauses 9 or 10. |

Should you fail to pay your invoice for services rendered, and as a
result, the matter of repayment is passed to a solicitor or collection
agency, all commissions, solicitor's fees and any out-of-pocket expenses
will be borne by you. |

Whilst all care is taken by Audio Graffiti in checking the final draft
of your Work, Audio Graffiti accepts no responsibility for errors found
after you have proofed and signed-off on that final draft. |

The cost of fixing errors as described in clause 13 will be borne by
you. |

In relation to MIDI sequencing, final aural "colour" will
vary depending on the type and quality of sound card or synthesizer
module you have, and also on the patches or sound fonts selected by
you. Audio Graffiti will not be held responsible if your preferred sound
selections are less than satisfactory, or do not match the MP3 "draft"
version. |

About These Terms
As much as we hate to do this, it is a simple fact of business that we must
stipulate various terms and conditions under which orders are accepted. We
believe that legitimate clients will not have a problem with them.
If you do have a personal difficulty with the terms and conditions, but want
to do business with us, please let us know, and we will consider your concerns.
About Our Payment Terms
It is an unfortunate reality that not all of our clients are honest. A very small minority
of clients have taken advantage of their long-distance relationship with Audio Graffiti to avoid making payment.
Audio Graffiti is a small business and cannot afford to wear the loss of many hours that
occurs when clients default on payments.
So from January 2006, we require all clients to pay a deposit when formalising
their order, then to pay the balance after the work is complete but before
receiving the first draft. Customers with an established history of paying
promptly may be exempt from this.
