Terms & Conditions
By submitting an order to Audio Graffiti, you acknowledge your acceptance of these terms and conditions:
Standard payment terms: for jobs with a quoted value of under $500 AUD, payment in full is required in advance. Where our quote for a job is $500 AUD or more, a deposit of 50% is required in advance, with the balance due when the work is complete and ready to send. Audio Graffiti reserves the right to vary this condition in special circumstances.
Australian residents are required to pay GST, and our quotes will indicate the amount of GST payable (GST does not apply to international customers).
All prices quoted are fixed for individual jobs. However, payment rates are subject to change without notice and from job to job. Customers should not assume that because one job cost a certain amount, all other jobs will cost the same amount.
Customers who cancel their job requests after work has begun will forfeit a part or all of their deposit or payment in order to compensate Audio Graffiti for time spent on that work.
Where Audio Graffiti cancels a job, Audio Graffiti will refund all payments made in relation to that work.
All prices for digital recording and MIDI rendering work include the cost of materials and postage required to return the finished product to the customer.
The price for engraving and transcription work does not include volume printing or binding of a manuscript into a book or manual. Price for work of this nature will be quoted separately on request. Audio Graffiti can usually provide a single hard copy of the work or a copy on CD at no additional cost.
The final product for engraving and transcribing work will be in the form of a PDF file prepared at a resolution suitable for professional printing. The file or files will be returned using email.
The final product for all MIDI sequencing work will be in the form of a MIDI file set up to play back according to General MIDI conventions unless otherwise specified. The file or files will be returned using email.
Audio Graffiti will correct errors and faults that it is responsible for at no cost to the client. After the initial draft, Audio Graffiti will offer up two more versions, each time seeking comment and feedback from the customer. Customers are responsible for reporting all errors, inconsistencies and flaws to Audio Graffiti during this draft phase.
Whilst all care is taken by Audio Graffiti in checking the final draft of your Work, Audio Graffiti accepts no responsibility for errors found after you have proofed and signed-off on that final draft.
The cost of fixing errors as described in clause 11 will be borne by the Client.
Audio Graffiti will not be held liable for jobs that are delayed due to factors beyond its control (such as internet/server outages, power outages, slow responsiveness from customers).
The Client warrants that it has copyright in, or a licence to authorise reproduction of, all music (“Works”) supplied by it to Audio Graffiti for the purposes of transcription, recording or sequencing. The Client authorises Audio Graffiti to reproduce all and any of the Works for such purposes.
Unless the Client advises to the contrary, the Client additionally licenses Audio Graffiti to use small portions of the Works in its own promotional materials to depict the quality or range of its goods or services.
The Client indemnifies and will keep Audio Graffiti indemnified against any liability, loss or expense suffered by Audio Graffiti as a direct or indirect result of any use of the Works by Audio Graffiti pursuant to clauses 14 or 15.
Should a Client fail to pay for services rendered, the Client will be held accountable for costs associated with employing a solicitor or collection agency to enforce payment.
In relation to MIDI sequencing, final aural “colour” will vary depending on the type and quality of sound card, synthesizer module or sample library you have, and also on the patches and samples selected by you. Audio Graffiti will not be held responsible if your preferred sound selections are less than satisfactory, or do not match the MP3 “draft” version produced on our system.
All terms and conditions are subject to change without notice.
